Recommendations States should adopt the best of both approaches by the five pioneers in marijuana reform. Promising results in California, Massachusetts, and (to a lesser extent) Connecticut indicate a pathway toward reducing the price that current policies inflict on young people, while reforms in Colorado and Washington initiated a pathway to legalized, regulated, and taxed marijuana production and sales. However, the egregious racial disparities that persist in these states indicate marijuana reforms should extend beyond marijuana policy — most urgently, toward reforming police procedures and practices that contribute significantly to these racial disparities (see CJCJ, 2012; ACLU, 2013). Learning from the progress of all five states is essential to designing marijuana reforms that move toward full legalization, regulation, and taxation of marijuana production, sale, possession, and use. Marijuana regulation should discriminate on the basis of responsible versus harmful use, such as dependency or driving under the influence, with the overriding goal of treatment and return to society — not policing and punishing by race, age, or other demographic factors.
